Rights of Usage The purchase of a digital image from Gary Mitchell Photography is a contractual agreement to use the image(s) for the sole stated purpose. Should a purchaser need to create multiple products, the image(s) may require re-purchase for each subsequent new product. Purchased images can be used for the agreed time only.
Terms and Conditions for Reproduction and Usage of Gary Mitchell's Photographic Images 1.Copyright: The copyright for photographs is retained exclusively by Gary Mitchell Photography.
2. Moral rights: The rights of Gary Mitchell Photography to protect our reputation as authors and creators. They include the right to be identified as author, the right not to be falsely identified as author, and the right not to have material altered in a way derogatory to the reputation of the author.
3. Title and Ownership of Materials: The title and ownership of all photographs remains the property of Gary Mitchell Photography. When the agreed usage licence for images has expired, these images must be removed or deleted from all hard drives, DVDs, CDs or other storage within 30 days.
4. Reproduction Rights: Reproduction rights are non-exclusive and for single use only in the United Kingdom. Single use is defined as the reproduction in one size for one edition of a single publication or advertising material. Usage is strictly limited to the purchaser, for the time period, specified at purchase, of between six months and two years, and not transferable for use or re-sale..
5. Payment: Payment for commissioned work is required within 30 days of the issue of a relevant invoice. Failure to pay in full, within 30 days will result in Gary Mitchell Photography reserving the right to charge interest at the Late Payment of Commercial Debt (interest) Act 1998 prescribed rate, from the due date until full payment is received.
